TERMS AND CONDITIONS OF SALE
Paid Products
Some of the Products offered on this Website as part of the Service are subject to payment.
The fees, duration, and conditions applicable to the sale of such Products are described below and in the respective sections of this Website.
To purchase the Products, the User is required to register or log into this Website.
Product Description
Prices, descriptions, and availability of Products are specified in the respective sections of this Website and are subject to change without notice.
Although the Products on this Website are presented with the greatest accuracy technically possible, the representation on this Website by any means (including, as applicable, graphical materials, images, colors, sounds) is for reference only and does not imply any warranty as to the characteristics of the purchased Product.
The characteristics of the selected Product will be outlined during the purchase process.
Purchase Process
Every step, from selecting a product to submitting the order, forms part of the purchase process.
The purchase process includes these steps:
- By clicking the checkout button, Users will access the Stripe checkout area, where they are required to provide their contact details and a payment method of their choice.
- After providing all requested information, Users must carefully review the order, confirm it, and submit it using the relevant button or mechanism on this Website, thereby accepting these Terms and committing to pay the agreed price.
Order Submission
Submitting the order entails the following:
- The submission of the order by the User concludes the contract and creates an obligation for the User to pay the price, taxes, and additional charges and expenses, as specified on the order page.
- If the purchased Product requires an action by the User, such as providing information or personal data, specifications, or particular requests, the order submission also creates the obligation for the User to cooperate accordingly.
- Once the order is submitted, Users will receive a confirmation of receipt of the order.
All notifications related to the purchase process described above will be sent to the email address provided by the User for such purposes.
Prices
During the purchase process and before submitting the order, Users are duly informed of all fees, taxes, and costs (including shipping costs, if applicable) that will be charged.
The prices on this Website:
- Depending on the section being consulted by the User, include all applicable fees, taxes, and costs or are indicated net of fees, taxes, and costs.
Promotions and Discounts
The Owner may offer discounts or special promotions for the purchase of Products. Such promotions or discounts are always subject to the requirements and terms and conditions set forth in the corresponding section of this Website.
Promotions and offers are granted at the sole discretion of the Owner.
Repeated or periodic promotions or discounts do not constitute any claim or right enforceable by Users in the future.
Where applicable, discounts and promotions are valid for a specific period of time or until stocks are exhausted. Unless otherwise specified, the time limitations of promotions and discounts refer to the time zone of the Owner's registered address, as indicated in this document.
Vouchers
Promotions and discounts may be offered in the form of Vouchers.
In the event of any violation of the conditions applicable to Vouchers, the Owner may legitimately refuse to fulfill its contractual obligations and expressly reserves the right to take legal action, including seeking damages.
Additional or differing provisions applicable to the use of Vouchers detailed in the corresponding informational page or on the Voucher itself take precedence over the provisions outlined below.
Unless otherwise specified, the following rules apply to the use of Vouchers:
- Each Voucher is valid only when used in the manner and within the timeframe specified on the website and/or Voucher.
- The Voucher may be redeemed in full only at the time of purchase—it is not possible to use it partially.
- Unless otherwise specified, single-use Vouchers may be redeemed only once per purchase and, therefore, may only be redeemed once even in the case of installment purchases.
- Vouchers are non-cumulative.
- The Voucher must be used before the expiration date specified. Once expired, the Voucher will automatically be canceled. Any possibility of claiming rights, including a refund of the Voucher's value, is excluded.
- Users are not entitled to any credit/refund/compensation in the event of a difference between the Voucher value and the redeemed value.
- Vouchers are intended solely for non-commercial use. The reproduction, counterfeiting, and marketing of the Voucher are strictly prohibited, as is any unlawful activity related to the purchase and/or use of the Voucher.
Payment Methods
Details regarding accepted payment methods are highlighted during the purchase process.
Some payment methods are subject to additional conditions or involve additional costs. Detailed information can be found in the relevant section of this Website.
All payments are independently processed through third-party services. Therefore, this Website does not collect any payment-related information—such as credit card details—but receives a notification once the payment has been successfully completed. For more details on the processing of personal data and rights regarding such processing, Users may refer to this Website's privacy policy.
If payment through the available methods fails or is refused by the payment service provider, the Owner is under no obligation to execute the order. In such cases, the Owner reserves the right to request reimbursement of any costs or damages incurred by the failed payment from the User.
Authorization for Future Payments via PayPal
If the User authorizes the PayPal feature that enables future purchases, this Website will store an identification code linked to the User's PayPal account. This allows this Website to automatically process payments for future purchases or recurring installments of a previous purchase.
The authorization can be revoked at any time by contacting the Owner or changing the User's PayPal settings.
Reservation of Ownership
Until the Owner receives full payment of the purchase price, the User does not acquire ownership of the ordered Products.
Delivery
Deliveries are made to the address specified by the User and in the manner described in the order summary.
Upon delivery, Users are required to verify the contents of the package and promptly notify any anomalies using the contact details provided in this document or as described in the delivery note. Users may refuse to accept the package if it is visibly damaged.
Deliveries are made to the following countries or territories: Switzerland.
Delivery times are specified on this Website or during the purchase process.
Failed Delivery
The Owner is not liable for any delivery errors resulting from inaccuracies or omissions made by the User during the purchase process, nor for damages or delays occurring after delivery to a courier chosen and approved by the User.
If goods are not delivered or collected at the specified time or within the stipulated period, they will be returned to the Owner, who will contact the User to schedule a second delivery attempt or to agree on further arrangements.
Unless otherwise specified, any second delivery attempt is at the User's expense.
User Rights
Right of Withdrawal
Unless exceptions apply, the User may withdraw from the contract within the period specified below (usually 14 days) for any reason and without justification. More information on the right of withdrawal is provided in this section.
Who is Entitled to the Right of Withdrawal?
The right of withdrawal enables European Consumers to withdraw from contracts concluded at a distance (as the User cannot see or test the Product before concluding the contract). Withdrawal from the contract releases both parties from the obligation to execute it.
On this Website, the right of withdrawal applies to all Users, without prejudice to any more specific rights available to them under applicable law and/or this document.
Unless one of the exceptions mentioned below applies, European Consumers are entitled to withdraw from a contract within the timeframe specified below for any reason and without justification. Users will only be liable to the Vendor for any diminished value of the goods resulting from handling the goods in a manner other than what is necessary to establish their nature, characteristics, and functioning.
How to Exercise the Right of Withdrawal
To exercise the right of withdrawal, Users must notify the Owner of their unequivocal intention to withdraw from the contract.
To do so, Users may use the template withdrawal form provided in the definitions section of this document. However, Users are free to express their intention to withdraw in any suitable manner.
To meet the withdrawal deadline, Users must send the declaration of withdrawal before the withdrawal period expires.
When Does the Withdrawal Period Expire?
- For the purchase of goods, the withdrawal period expires 14 days after the day the User—or a third party appointed by the User and different from the courier—takes possession of the goods.
- In the case of multiple goods ordered together but delivered separately, or in the case of the purchase of a single good delivered in separate lots or pieces, the withdrawal period expires 14 days after the day the User—or a third party appointed by the User and different from the courier—takes possession of the last of the goods, lots, or pieces.
Effects of Withdrawal
The Owner reimburses all payments received, including, where applicable, delivery costs, to Users who correctly exercise their right of withdrawal.
However, the additional cost resulting from the choice of a specific delivery method other than the least expensive standard delivery offered by the Owner remains the responsibility of the User.
The reimbursement will occur without undue delay and, in any case, within 14 days from the day the Owner was informed of the User's decision to withdraw from the contract. Unless otherwise agreed with the User, the reimbursement will be made using the same payment method used for the initial transaction. The User will not incur any costs as a result of the withdrawal.
...On Contracts for the Purchase of Tangible Goods
Unless the Owner has offered to collect the goods, the User must return them to the Owner or another authorized person without undue delay and, in any event, within 14 days from the day they communicated their intention to withdraw from the contract.
The deadline is met if the goods are delivered to the courier or another authorized person before the expiration of the 14-day period described above. Reimbursement may be withheld until the goods are received or until the User has provided proof of having returned them.
The User is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, and functioning.
Return shipping costs are borne by the User.
Exceptions to the Right of Withdrawal
The right of withdrawal does not exist for contracts involving:
- The supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Guarantees
Legal Guarantee of Product Conformity According to EU Law
Under European law, sellers guarantee the conformity of goods sold to Consumers for a minimum of 2 years after delivery.
If Users are acting as European Consumers, the legal guarantee of conformity applies to items available on this Website in accordance with the laws of the country in which they habitually reside.
The national laws of that country may grant Users broader rights.
Consumers who are not considered European Consumers may benefit from conformity guarantee rights under the laws of the country in which they habitually reside.
Limitation of Liability and Indemnity
Australian Users
Limitation of Liability
Nothing in these Terms excludes, limits, or modifies any guarantee, condition, indemnity, right, or protection that Users may have under the Competition and Consumer Act 2010 (Cth) or other similar state and territorial legislation and that constitutes a right which cannot be excluded, limited, or modified (Non-Excludable Right). To the maximum extent permitted by law, our liability to Users, including liability for the breach of a Non-Excludable Right and any other liability not otherwise excluded under these Terms and Conditions, is limited, at the Owner's discretion, to a new supply of services or payment of the cost for the repetition of their supply.
U.S. Users
Disclaimer of Warranties
The Owner provides this Website "as is" and "as available." The use of the Service is at the User's own risk. To the maximum extent permitted by applicable law, the Owner expressly disclaims all conditions, representations, and warranties—whether express, implied, statutory, or otherwise, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party rights. No advice or information, whether oral or written, obtained by the User from the Owner or through the Service will create any warranty not expressly stated herein.
Without limiting the foregoing, the Owner and its subsidiaries, affiliates, licensors, officers, agents, co-brand owners, partners, suppliers, and employees do not warrant that the content is accurate, reliable, or correct; that the Service will meet User requirements; that the Service will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the Service is free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the Service is downloaded at the User's own risk, and Users will be solely responsible for any damage to their computer system or mobile device or loss of data that results from such download or use of the Service.
The Owner does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Service or any hyperlinked website or service. Furthermore, the Owner shall not be a party to or in any way monitor any transaction between Users and third-party providers of products or services.
The Service may become inaccessible or may not function properly with the User's web browser, device, and/or operating system. The Owner cannot be held liable for any perceived or actual damages arising from the content, operation, or use of the Service.
Federal laws, some states, and other jurisdictions do not allow the exclusion and limitations of certain implied warranties. The above exclusions may not apply to Users. This Agreement gives Users specific legal rights, and Users may also have other rights which vary from state to state. The disclaimers and exclusions under this Agreement shall not apply to the extent prohibited by applicable law.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Owner and its subsidiaries, affiliates, officers, agents, co-brand owners, partners, suppliers, and employees be liable for:
- Any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to the use of or inability to use the Service;
- Any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or the User account or the information contained therein;
- Any errors, mistakes, or inaccuracies in the content;
- Personal injury or property damage of any nature whatsoever resulting from the User's access to or use of the Service;
- Any unauthorized access to or use of the Owner's secure servers and/or any personal information stored therein;
- Any interruption or cessation of transmission to or from the Service;
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service;
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or
- The defamatory, offensive, or illegal conduct of any User or third party. In no event shall the Owner and its subsidiaries, affiliates, officers, agents, co-brand owners, partners, suppliers, and employees be liable for any claims, proceedings, liabilities, obligations, damages, losses, or costs for an amount exceeding the amount paid by the User to the Owner in the preceding 12 months, or the duration of this Agreement between the Owner and the User, whichever is shorter.
This limitation of liability section shall apply to the fullest extent permitted by law in the applicable jurisdiction whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if the Owner has been advised of the possibility of such damage.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to the User. These Terms give the User specific legal rights, and the User may also have other rights which vary from jurisdiction to jurisdiction. The disclaimers, exclusions, and limitations of liability under these Terms shall not apply to the extent prohibited by applicable law.
Indemnity
The User agrees to defend, indemnify, and hold the Owner and its subsidiaries, affiliates, officers, agents, co-brand owners, partners, suppliers, and employees harmless from and against any and all claims or demands, damages, obligations, losses, liabilities, costs or debt, and expenses, including, but not limited to, legal fees and expenses, arising from:
- The User's use of and access to the Service, including any data or content transmitted or received by the User;
- The User's violation of these Terms, including, but not limited to, any breach by the User of any representations or warranties set forth in these Terms;
- The User's violation of any third-party rights, including, but not limited to, any right of privacy or intellectual property rights;
- The User's violation of any law, rule, or regulation;
- Any content submitted from the User's account, including third-party access with the User's unique username, password, or other security measure, if applicable;
- The User's willful misconduct; or
- Any other action related to the User's use of the Service or the violation of any applicable law.
Common Provisions
No Waiver
The Owner’s failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.
Service Interruption
To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates, or any other changes, giving appropriate notice to Users.
Within the limits of the law, the Owner may also decide to suspend or terminate the Service altogether. If the Service is terminated, the Owner will cooperate with Users to enable them to withdraw their Personal Data or information in accordance with applicable law.
Furthermore, the Service might not be available for reasons beyond the Owner's reasonable control, such as force majeure (e.g., infrastructure failures, power outages, etc.).
Resale of the Service
Users are not allowed to reproduce, duplicate, copy, sell, resell, or exploit any portion of this Website or its Service without the Owner’s express prior written permission, granted either directly or through a legitimate resale program.
Privacy Policy
To learn more about the use of their Personal Data, Users may refer to the privacy policy of this Website.
Intellectual Property Rights
Without prejudice to any more specific provisions of these Terms, any intellectual and industrial property rights, such as copyrights, trademarks, patents, and designs related to this Website are the exclusive property of the Owner or its licensors and are protected by applicable laws and international treaties related to intellectual property.
All trademarks—whether word or figurative marks—and all other marks, trade names, service marks, illustrations, images, or logos appearing in connection with this Website are, and remain, the exclusive property of the Owner or its licensors and are protected by applicable laws and international treaties related to intellectual property.
Changes to These Terms
The Owner reserves the right to amend or otherwise modify these Terms at any time. In such cases, the Owner will appropriately inform the User of these changes.
The changes will only affect the relationship with the User for the future.
The continued use of the Service will signify the User’s acceptance of the revised Terms. If Users do not wish to be bound by the changes, they must stop using the Service. Failure to accept the revised Terms, where required, may entitle either party to terminate the Agreement.
If required by applicable law, the Owner will specify the date by which the modified Terms will enter into force.
Assignment of Contract
The Owner reserves the right to transfer, assign, dispose of by novation, or subcontract any or all rights or obligations under these Terms, taking the User’s legitimate interests into account. Provisions regarding changes of these Terms will apply accordingly.
Users may not assign or transfer their rights or obligations under these Terms in any way without the written permission of the Owner.
Contacts
All communications relating to the use of this Website must be sent using the contact information stated in this document.
Severability
If any provision of these Terms is deemed invalid or unenforceable under applicable law, the invalidity or unenforceability of such a provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
U.S. Users
Any such invalid or unenforceable provision will be interpreted and adapted to the extent necessary to make it valid, enforceable, and consistent with its original purpose.
These Terms constitute the entire Agreement between Users and the Owner with respect to the subject matter regulated herein, and supersede all other communications, including prior agreements, between the parties with respect to such subject matter.
These Terms will be enforced to the fullest extent permitted by law.
EU Users
If any provision of these Terms is or is found to be invalid, unlawful, or unenforceable, the parties will endeavor to find, by mutual agreement, an amicable provision to substitute the invalid, unlawful, or unenforceable one.
In case of failure to do so, the invalid, unlawful, or unenforceable provision shall be replaced by the applicable statutory provisions, if so permitted or stated under applicable law.
This does not affect the rest of these Terms.
Governing Law
These Terms are governed by the law of the place where the Owner is based, as disclosed in the relevant section of this document, without regard to conflict of laws principles.
Exception for European Consumers
However, regardless of the above, if the User qualifies as a European Consumer and resides in a country where the law provides for a higher level of consumer protection, such higher standards shall prevail.
Jurisdiction
The exclusive competence to decide on any controversy resulting from or connected to these Terms lies with the courts of the place where the Owner is based, as shown in the relevant section of this document.
Exception for European Consumers
The above does not apply to Users acting as European Consumers or Consumers based in Switzerland, Norway, Iceland, or the United Kingdom.
Dispute Resolution
Amicable Dispute Resolution
Users may bring any disputes to the Owner, who will try to resolve them amicably.
While Users' right to take legal action shall always remain unaffected, in the event of any controversy regarding the use of this Website or the Service, Users are kindly asked to contact the Owner using the contact details provided in this document.
The User may submit their complaint, including a brief description and, if applicable, details about the related order, purchase, or account, to the Owner's email address specified in this document.
The Owner will process the complaint without undue delay and within 21 days of receiving it.
Online Dispute Resolution for Consumers
